USA – Proposed to establish the Safety Standard for Magnets

Content The U.S. Consumer Product Safety Commission (CPSC) has proposed the Safety Standard for Magnets to regulate consumer products that are designed, marketed, or intended to be used for entertainment, jewelry (including children's jewelry), mental stimulation, stress relief, or a combination of these purposes, and that contain one or more loose or separable magnets. Toys that are subject to CPSC's mandatory toy standard are exempt from the proposed rule. Each loose or separable magnet in a product that is subject to the proposed rule and that fits entirely within CPSC's small parts cylinder would be required to have a flux index of less than 50 kG2 mm2.

16 CFR 1112 Requirements Pertaining to Third Party Conformity Assessment Bodies would therefore be proposed to amend to add this proposed standard for magnets to the list of children's product safety rules, and a new 16 CFR 1262 Safety Standard for Magnets will be created accordingly. Here's the highlight of the new Standard:

Scope:
the following magnet products, excluding toys, that are manufactured in the United States, or imported are subject to this new Standard:

  1. for sale to a consumer for use in or around a permanent or temporary household or residence, a school, in recreation, or otherwise, or
  2. for the personal use, consumption or enjoyment of a consumer in or around a permanent or temporary household or residence, a school, in recreation, or otherwise.'' The term does not include products that are not customarily produced or distributed for sale to, or for the use or consumption by, or enjoyment of, a consumer.

Magnet product:
means a consumer product that is designed, marketed, or intended to be used for entertainment, jewelry (including children's jewelry), mental stimulation, stress relief, or a combination of these purposes, and that contains one or more loose or separable magnets.

Requirements:
Each loose or separable magnet in a magnet product that fits entirely within the cylinder described in 16 CFR 1501.4 must have a flux index of less than 50 kG2 mm2 when tested in accordance with the method described in the Standard.
