On 18 February 2025, the European Commission proposed a delegated regulation to amend Annex I to Persistent Organic Pollutants Regulation (EU) 2019/1021 as regards the entry of polychlorinated biphenyls (PCB). According to the proposed delegated regulation, the following specific exemption shall be added:

For the purposes of this entry, the exemption from control measures shall apply to the sum of concentrations of PCB equal to or below 0.2 mg/kg (0.00002% by weight) where they are present in substances, mixtures or articles.

For organic pigments and organic dyes, and for mixtures and articles containing organic pigments or organic dyes, the PCB content limit will be 25 mg/kg (0.0025% by weight) (sum), and further 10 mg/kg (0.001% by weight) (sum) three years after the regulation enters into force.

Polychlorinated biphenyls (PCB) were insulating fluids in EEE and additives in e.g., paints, sealants and carbon paper. In May 2001, the substance was listed in Annex A to the UN Stockholm Convention, and it was decided that the production and use of the substance shall be eliminated globally.
