EU - ECHA Proposes Restriction on 2,4-DNT under REACH Annex XVII

On 22 September 2021, the European Chemical Agency (ECHA) has launched a public consultation on restricting the substance 2,4-dinitrotoluene (2,4-DNT) (CAS No. 121-14-2) in Annex XVII of the REACH Regulation (EC) No 1907/2006. The proposed restriction would prevent the placing on the market of 2,4-DNT and the use in articles containing 2,4-DNT in concentrations equal to or greater than 0.1% by weight.

The 2,4-DNT substance was found to be used in articles (such as refractories, in automotive airbags, in seat belt pre-tensioners, in plastic bottles used in industrial settings for sample taking purposes, and in propellants for military and civil small-arms ammunitions). The substance is classified as a carcinogen category 1B (associated with renal cell cancer), was included in the candidate list for authorisation (SVHC list) and into Annex XIV of REACH Regulation (EC) No 1907/2006 with a sunset date of 21 August 2015.

1. Shall not be placed on the market, or used, as a substance in articles for supply to the general public or to professional workers in concentrations ≥ 0.1 % weight by weight.
2. Paragraph 1 shall not apply to a substance in articles placed on the market or used in:
a. Explosives,
b. Ammunition used for military use.
3. Paragraph 1 shall not apply to a substance in articles regulated by:
a. Directive 2009/48/EC on the safety of toys,
b. Regulation (EU) 2017/745 on medical devices,
4. For the purposes of this entry, professional uses mean uses by workers that take place outside of industrial premises and where fixed risk management measures cannot be used or where consumers are exposed.
5. The restriction should enter into force after 12 months.

The consultation on this proposed restriction starts on 22 September 2021 and ends on 22 March 2022. The final opinions of both Risk Assessment Committee (RAC) and Socio-Economic Assessment Committee (SEAC) are scheduled to be available by September 2022. ECHA will send the joint opinion of the Committees to the European Commission, which will take the decision whether to include the proposed restriction in Annex XVII of the REACH Regulation.
