1. < Implementation Measures for Vacation Leaves such as Marriage Leave, Maternity Leave, Paternity Leave, Parental Leave and Nursing Leave > in Tianjin Municipality (2022-05-17)
On 17th May 2022, the General Office of Tianjin Municipal People's Government issued the Implementation Measures for Vacation Leaves such as Marriage Leave, Maternity Leave, Paternity Leave, Parental Leave and Nursing Leave (hereinafter referred to as the Measures).
The Measures stipulate vacation benefits. Marriage leave, paternity leave, parental leave and nursing leave are regarded as normal attendance, and wages and welfare benefits are paid as usual; The relevant treatment during maternity leave shall be implemented in accordance with the relevant provisions of the state and Tianjin municipal. If the employee fails to enjoy the above-mentioned leave in time due to the reasons of the employer, the employer shall arrange compensatory leave for the employee.
The Measures stipulate that marriage leave and parental leave are working days, excluding statutory holidays and rest days; Maternity leave, paternity leave and nursing leave are natural days, including statutory holidays and rest days. Marriage leave, maternity leave and paternity leave should generally be used continuously; Parental leave and nursing leave can either be used continuously or dispersed according to the actual situation of the family.
The special provisions on parental leave in the Measures: for families with multiple children, parental leave is calculated according to the number of children born by the couple, and the number of vacation days for couples in families with multiple children is accumulated. The period of parental leave is calculated based on the actual age of the child; If the parental leave is not taken in the current year, it will generally not be extended to the next year.
The vacations stipulated in the Measures shall be implemented from 29th November 2021.

1. < Regulations on the Protection of Intellectual Property Rights in Beijing Municipality > (2022-07-01)
The Regulations on the Protection of Intellectual Property Rights in Beijing Municipality (hereinafter referred to as the Regulations) was adopted on 31st March 2022 and will come into force on 1st July 2022.
The Regulations have seven chapters and 57 articles, which are divided into general provisions, administrative protection and judicial protection, social co-governance, promotion and service, diversified mediation of disputes, legal liability and supplementary provisions. The main contents include four aspects:
1.Strengthen the administrative and judicial protection of intellectual property rights and improve the quality and efficiency of intellectual property protection;
2.Strengthen intellectual property protection in key and emerging fields and build a pattern of social co governance;
3.Strengthen public services and promote the high-quality creation and application of intellectual property rights;
4.Promote diversified mediation of intellectual property rights disputes and promote the rapid resolution of intellectual property rights disputes.

1. < Guangdong Implementation Measures of the Fire Prevention Law of the People's Republic of China > (2022-07-01)
The Measures of Guangdong Province for Implementing the Fire Prevention Law of the People's Republic of China (hereinafter referred to as the Measures), which were voted and adopted at the 41st meeting of the Standing Committee of the 13th Guangdong Provincial People's Congress on 29th March 2022 are hereby promulgated and will come into force as since 1st July 2022. The main amendments of the Measures are as follows:
1.The Measures define that, for residential districts, residential buildings and densely populated places planned or under construction should set up centralized parking and charging places for electric vehicles in accordance with regulations, and charging facilities shall be equipped with charging facilities that meet the requirements of electricity safety, and fire separation measures shall be taken.
2.The Measures stipulate that it is prohibited to park or charge electric vehicles in public halls, evacuation routes, emergency exits, staircases and indoor places that do not meet fire safety conditions.
3.The Measures stipulate that fire safety assessment shall be organized at least once a year in key fire safety units, such as densely populated places are prone to cause mass casualties, flammable and explosive units, high-rise and underground public buildings and other high-risk fire units.
4.The Measures exploratorily stipulate that small and micro enterprises can perform relevant fire safety duty through the way of cluster hosting and resource sharing.
Environment
1. < Implementation Plan for the Work of Environmental Impact Assessment and Pollutant Discharge Permit during the 14th Five-Year Plan Period > (2022-04-01)
On 1st April 2022, the Ministry of Ecological Environment issued and implemented the Implementation Plan for the Work of Environmental Impact Assessment and Pollutant Discharge Permit during the 14th Five-Year Plan Period (hereinafter referred to as the Plan), systematically summarized the progress made and challenges faced under the new situation for the work of environmental assessment and pollutant discharge permit during the 13th five year plan period, and defined the guiding ideology, basic principles and main objectives for the work of environmental assessment and pollutant discharge permit during the 14th Five Year Plan period. The key tasks are to deepen the reform of system and mechanism, strengthen the zoning control of ecological environment, environmental assessment management, the core system of pollutant discharge permit and capacity-building.
The Plan is a special planning plan in the field of environmental impact assessment and pollutant discharge permit management during the 14th Five Year Plan period, and points out the objectives, ideas, measures and key tasks for the work in the next few years. It is also the implementation plan for the implementation of top-level policy documents in the field of environmental impact assessment and pollutant discharge permit, such as the Opinions of the CPC Central Committee and the State Council on Deepening the Battle of Pollution Prevention and Control, the Opinions of the CPC Central Committee and the State Council on Completely, Accurately and Comprehensively Implementing the New Development Concept and Doing a Good Job in Carbon Peak and Neutralization, and the Notice of the Action Plan for Carbon Peak before 2030.
The Plan focuses on "improving the source prevention system with the environmental impact assessment system as the main body, and building a fixed pollution source supervision system with the pollutant discharge permit system as the core", and highlights the deepening of the reform of "streamline administration and delegate power, improve regulation, and upgrade services" of environmental assessment and pollutant discharge permit, and the coordinated promotion of pollution and carbon reduction.
The Plan defines the goal of further enriching the institutional innovation system during the 14th Five Year Plan period. Initially establish a closed-loop management system of ecological environment zoning control, planning EIA, project EIA, pollutant discharge permit, law enforcement, supervision and other relevant systems. Explore the environmental impact assessment of greenhouse gas emissions.
2. < Law of the People's Republic of China on the Prevention and Control of Noise Pollution > (2022-06-05)
The Law of the People's Republic of China on the Prevention and Control of Noise Pollution (hereinafter referred to as the Law on the Prevention and Control of Noise Pollution) was adopted by the Standing Committee of the National People's Congress on 24th December 2021 and will come into force on 5th June 2022. The Law of the People's Republic of China on the Prevention and Control of Environmental Noise Pollution shall be abolished simultaneously.
This amendment is revised from 64 articles in eight chapters to 84 articles in nine chapters. This amendment increases the targets of prevention and control, adjusts the scope of application, improves the responsibilities of the government and its relevant departments, strengthens source prevention and control and noise classification management, strengthens social co-governance, clarifies legal responsibilities and increases punishment.
The following are the key areas for enterprises to focus on:
•The Law on the Prevention and Control of Noise Pollution redefines the connotation of noise pollution. For some noise-producing areas without noise emission standards, on the basis of "exceeding the standard + disturbing residents", the cases of "not taking prevention and control measures according to law" causing noise to interfere with others' normal life, work and study are defined as noise pollution.
•The Law on the Prevention and Control of Noise Pollution focuses on strengthening the prevention and control of sources and improving the planning, standards, monitoring and environmental assessment system. In terms of monitoring, the contents of promoting monitoring automation, noise emission monitoring in key areas such as the periphery of noise sensitive buildings, and self-monitoring and automatic monitoring of enterprises are added. In terms of environmental impact assessment, it clearly defines that the planning environmental impact assessment should include the prevention and control of noise pollution.
•The Law on the Prevention and Control of Noise Pollution stipulates that enterprises, institutions and other business managers that use facilities and equipment that may produce noise pollution in social life shall take measures such as optimizing layout and centralized emission to prevent and reduce noise pollution.
