On December 8, 2023, the U.S. Consumer Product Safety Commission (CPSC) issued a supplemental notice of proposed rulemaking (SNPR) to revise 16 CFR Part 1110 - Certificates of Compliance. The SNPR proposes to align the certificate rule with other CPSC rules on testing and certification, and to implement, for imported CPSC-regulated products and substances, electronic filing of certificates (eFiling) with U.S. Customs and Border Protection (CBP).
The public comment period ended on February 6, 2024. CPSC is actively developing the eFiling program and the rulemaking will be finalized in September 2024 and the eFiling requirements will be implemented in 2025.
The eFiling initiative will enable importers to electronically file the data elements required from a certificate of compliance electronically with U.S. Customs and Border Protection (CBP).
