USA CPSC Approved to Update the Safety Standard for Gates and Enclosure (16 CFR 1239)
On Apr 1, 2026, the U.S. Consumer Product Safety Commission (CPSC) has published a direct final rule to update the Safety Standard for Gates and Enclosures (16 CFR 1239). The regulation shall enter into force on July 19, 2026.
According to the Standard, each gate and enclosure must comply with all applicable provisions of ASTM F1004–25, Standard Consumer Safety Specification for Expansion Gates and Expandable Enclosures.
The main revision of this standard this time is to change the referenced product standard from ASTM F1004-22 to ASTM F1004-25. The involved changes are as follows:
- Add note 12 in clause 8.5.7.1, indicating the warning statement “You MUST install [wall cups] to keep gate in place. Without [wall cups], child can push out and escape.” need to be set separately from other warning statement only on the product, which is not required to be separate on the packaging and the instructions.
- Add clause 6.9 to require expansion gates and expandable enclosures under the scope of this consumer safety specification shall not include any features or openings within the gate that allow for unassisted pet entry or egress.
